The Independence of the Judiciary, a Process in the Making, Nepali Context

Abstract:
For the purposes of the the presentation, I wish to speak about three issues, firstly the importance of the independence of the judiciary. How the fundamental concept emanating from the principle of separation of powers finds place in the constitution, and other acts of Nepal. Secondly, I wish to speak about the practical aspect, how it is applies to the Nepali context. In this regard, I would like to discuss three incidents, the impeachment of Sushila Karki, the role of Cholendra Shumsher when he was Chief Justice, and the latest, the non-appointment of Sapana Malla. Lastly I would like to talk about the reforms needed to make this idea more approachable, and also the feminist angle - considering two of the cases above include women.
About the Speaker:
Prakritee Yonzon is an international lawyer and academic. She has taught and practised law in multiple jurisdictions. She completed her LL.M. from the London School of Economics and Political Science, and has recently completed her PhD from the University of Hong Kong on arbitration in South Asia.
